In many cases, offering individuals the opportunity to personally design the outcome of a dispute, significantly reduces the financial burden and fear of an uncertain judgment most encounter when going through the traditional legal process.

Are Mediated Agreements an Order of The Court?

Mediated agreements are considered a Memorandum of Understanding between the parties. If the parties would like to have the agreement made an Order of the Court, the agreement has to be written in legal language and entered into the Court as an Agreed Entry by an attorney. We are prepared to assist in this process at the parties' request.

Can Mediated Agreements be modified?

Yes. Many times parties relocate, work schedules change, and as children get older their needs change as well, all requiring the parties to modify their original agreement to meet their current needs.

What will happen if no agreement is reached?

Mediation is a voluntary process. Individual(s) have the right to withdraw at anytime. If no agreement is reached parties can carry on with litigation if they choose.

What if there is an active Civil Protection Order?

After the Individual Assessment Meeting with the parties, the Mediator will establish if everyone can negotiate for themselves without coercion or intimidation. The Mediator then determines if the case is appropriate for mediation. If so, the Mediator will conduct a "Shuttle Mediation" in which the parties meet in separate rooms, avoiding any contact or direct communication with each other. This style allows the Mediator to express to the parties each others individual concerns in a matter and tone that is conducive to mutual understanding, while honoring the Civil Protection Order.

Can Mediation assist in the process of terminating a marriage?

Yes. Mediation allows parties to think "outside the box" and address matters regarding "their" lifestyle, along with covering all issues addressed in a standard divorce process such as:

  • Property Division

  • Tax Issues

  • Retirement

  • Pension

  • Child/Spousal Support

  • Parenting Schedules

  • Child Custody
